Calendar of FC Barcelona

The Fiscalía Anticorrupción has showed against of the investigation by cohecho to the FC Barcelona by his payments to the exvicepresidente of the CTA, Enríquez Negreira, contradicting to the judge Joaquín Aguirre to the not to consider him like a public civil servant. From 'EFE' have aimed that the public prosecutors have presented a report in which they adhere " to the resources that the defences interposed against the decision of the judge instructor to investigate to the Barcelona, to the directors of the club imputed and to the own Negreira by a crime of cohecho".

Now, it corresponds that the Audience of Barcelona revoke or no the decision adopted in September by Joaquín Aguirre, headline of the Court of Instruction number 1 of Barcelona and judge of the 'case Negreira'. The Fiscalía supports the resources presented by the defences -in front of the Audience- and stands out that, neither by analogy of functions, the exárbitro did not fulfil the 'condition' of public civil servant.

The intrahistoria of the imputación by cohecho to the Barça

Aguirre had taken the decision to impute to the FC Barcelona by cohecho, confirming in the judicial car that the payment of the blaugrana to the exvicepresidente of the CTA constitute a crime, reason by which also has imputed to the ex mandators Josep Maria Bartomeu and Sandro Rosell, as well as to José María Enríquez Negreira and his son Javier Enríquez Romero.

It had been a decision that generated a lot of controversy because they considered to Negreira like a "civil servant" in his quality of vice-president of the Technical Committee of Referees (CTA) and reported that "any civil servant can receive emolumentos by the fulfillment of the public function", basing in the jurisprudence of the High court in which it establishes that "it will consider public civil servant to all that that by immediate disposal of the Law, by election, or by nomination of competent authority participate in the exercise of public functions".
