Barça must look for solutions
The precautionary measure requested for the registration of Olmo and Pau Víctor has been rejected
The same judge who had approved the measure a year ago for the registration of Gavi has now denied that of the two Catalan footballers
Critical situation for Barça with the registration of Dani Olmo and Pau Víctor. The precautionary measure requested for the registration of both players has been rejected by Judge Ignacio Fernández de Senespleda, head of the Commercial Court number 10 of Barcelona. This Friday, the same professional who last year gave the club authorization to register Gavi, denied the legal permission that would allow the Blaugrana team to do the same with the two signings of the summer market.
With very little room for maneuver, since the ex-Leipzig player will be free in January if he is not part of the LaLiga census on December 31, the Catalan institution will exhaust all possible avenues to achieve the objective. On the one hand, it will try to close the commercialization of the VIP seats at the Spotify Camp Nou, which would work as a lever. Another way is the legal one and, according to La Vanguardia, the club presented two lawsuits at the same time: one in the commercial court, which is the one that has been rejected, and another in a first instance court, which will be resolved this Monday. Both request a precautionary measure.
Barça's enemies in the process
In the resolution of this case, which the club thought it would get away with as it did with Gavi, the process has been different. LaLiga has been called to testify through its lawyers. The organization rejects that FC Barcelona can register Pau Víctor and Dani Olmo with Ter Stegen's salary, because it considers that that space is occupied by Szczesny, whose remuneration is much lower than that of the German goalkeeper. This reason was what led the Blaugrana team to present the first lawsuit, before the commercial court.
Another reason why the situation is so complex is that three Spanish clubs are trying hard to prevent the institution presided over by Joan Laporta from winning the prize. They are Sevilla, Athletic Club and Atlético de Madrid. Because they did not agree with the Employers' Association when the issue was discussed, the judge in charge of the case called LaLiga to testify.
In this mess, FC Barcelona hopes that the court of first instance, in which the club is challenging the entire decision-making system of the LaLiga Delegated Commission, will rule in its favour on Monday. If this happens, everything will be joyful to end the year. However, if the injunction is denied again, there will be little room for manoeuvre in terms of the liquidation, with compensation in between, of Dani Olmo's contract. As a last resort, in case of emergency, the Board of Directors is keeping the personal guarantee route to get things out of the fire. Very nervous days at Can Barça.
